RELEASE AND WAIVER OF LIABILITY AGREEMENT FOR EXTREME FISHING CHARTERS.

 CONTRACTUAL ASSUMPTION ACKNOWLEDGEMENT OF RISKS AND LIABILITY RELEASE AND WAIVER AGREEMENT.

In consideration of being granted permission to participate in the charter organized by Extreme Fishing Charters, on behalf of myself and/or any minor children for whom I am the legal parent/guardian or otherwise responsible, as well as our heirs, personal representatives, or assigns:

ACKNOWLEDGEMENT OF RISKS

I am fully aware and acknowledge that participating in the charter entails certain risks, which may include, but are not limited to, the following: 1. Adverse weather conditions such as wind shear, inclement weather, lightning, and extreme variations in wind, weather, and temperature. 2. Physical factors such as balance, physical condition, ability to operate equipment, swim, and follow instructions. 3. Hazards such as collision, capsizing, sinking, and other circumstances that may result in wetness, injury, exposure to the elements, hypothermia, body impact with water, water entering body orifices, and drowning. 4. The presence of insects and marine life forms. 5. Potential equipment failure, operator error, and transportation accidents. 6. Risks associated with heat or sun exposure, including sunburn, sunstroke, and dehydration. 7. Possible fatigue, chill, and dizziness, which can impair reaction time and increase the risk of accidents. 8. Slippery decks when wet. By acknowledging these risks, I confirm that I understand the inherent dangers involved in the charter activities. I explicitly confirm that I have received comprehensive instructions and training regarding the safe utilization of the equipment utilized during this charter, and I am fully satisfied with the provided guidance. Furthermore, I affirm that I possess the necessary physical and mental capabilities to engage in the charter activities.

ASSUMPTION OF RISK AND RESPONSIBILITY AGREEMENT

I willingly and fully accept all responsibility for the risks associated with the upcoming charter, including those risks not explicitly mentioned above (I am fully aware that this includes assuming risks resulting from the negligence of the parties being released, as listed below). My participation in the charter is entirely voluntary, and I acknowledge that I am assuming complete responsibility for myself and any minor children under my care. This responsibility extends to any bodily injuries, accidents, illnesses, paralysis, loss of personal property, and related expenses that may occur during our participation in the activity. I fully comprehend and consent to assume all responsibility, both on my own behalf and on behalf of any minor children or children for whom I am legally responsible. I acknowledge that this responsibility encompasses any injuries, death, or loss of personal property, regardless of whether these incidents are partially or entirely caused by the negligence of the individuals or entities being released, as mentioned below. I hereby release Extreme Fishing Charters, their affiliated and related companies, their principals, directors, officers, agents, employees, and volunteers, as well as their insurers, and each and every landowner, municipal and/or governmental agency on whose property and activity is conducted, including their insurers if applicable. I release them from any and all liability, of any nature, for any injury or damage (including death) to myself, my minor children, and other individuals, arising from my/our participation in the activity. This release applies even if the injury or damage is caused by my own negligence, the negligence of any of the aforementioned releases, or any other person, including myself. I have carefully reviewed this agreement regarding the assumption of risks, acknowledgment, and release of liability. I acknowledge that this agreement is contractual in nature and applies to me personally. I am fully aware that by signing this document, I am relinquishing significant legal rights, including any claims or rights I may have against the owner, the aforementioned operator, as well as their employees, agents, servants, or assigns. In consideration of being granted the opportunity to participate in the charter, I completely agree to hold harmless and indemnify the owner, the aforementioned operator, as well as their employees, agents, servants, or assigns, from any injury, including death, that may befall myself, my minor children, or any children for whom I am legally responsible.
